CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-591 <br /> <br /> RESOLUTION DENYING THEAPPEAL OF STANLEY <br /> PARTNERS TO A DECISION OF THE PLANNING <br /> COMMISSION DENYING A CONDITIONAL USE <br /> PERMIT TO OPERATE A SUPERMARKET (CASE UP- <br /> 88-54) <br /> <br />WHEREAS, at this meeting of November 22, 1988, the Planning <br /> Commission denied the application of Stanley <br /> Partners for a conditional use permit to operate a <br /> supermarket on the site of a proposed shopping <br /> center, to be located on the north side of Stanley <br /> Boulevard between First Street and Valley Avenue <br /> (Case UP-88-54); and <br /> <br />WHEREAS, within the time specified by the Pleasanton <br /> Municipal Code, Stanley Partners submitted an <br /> appeal to the City Clerk of the City of Pleasanton; <br /> and <br /> <br />WHEREAS, a public hearing was held before the City Council <br /> on December 20, 1988 at which time all relevant <br /> testimony was considered and all relevant documents <br /> were reviewed; and <br /> <br />WHEREAS, based on the preponderance of evidence, the City <br /> Council finds that this appeal and this application <br /> should be denied based on the following: The <br /> proposed location of the supermarket use, with its <br /> proximity to existing residential town homes <br /> adjacent to the project site would generate land <br /> use conflicts; there is inadequate information <br /> about the specific supermarket tenant and until <br /> that information is known, conditions relative to <br /> limitations on delivery hours, noise abatement, <br /> adequate screening and reduction in glare from <br /> commercial lighting cannot be adequately <br /> addressed. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The appeal in Case UP-88-54, the application of <br /> Stanley Partners for a conditional use permit to <br /> operate a supermarket on the site of a proposed <br /> shopping center, on the north side of Stanley <br /> Boulevard between First Street and Valley Avenue, <br /> is DENIED and the decision of the Planning <br /> Commission is SUSTAINED. <br /> <br /> <br />
