CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-588 <br /> <br /> RESOLUTION GRANTING THEAPPEALOF STANLEY <br /> PARTNERS TO A DECISION OF THE PLANNING <br /> COMMISSION DENYING A GENERAL PLAN <br /> AMENDMENT FOR PROPERTY AT 3963 STANleY <br /> BOULEVARD (CASE GP-88-6). <br /> <br />WHEREAS, at its meeting of October 26, 1988, the Planning <br /> Commission denied the application of Earl Augusta <br /> and Stanley Partners for a general plan amendment; <br /> and <br /> <br />WHEREAS, said ,~pplication sought to amend the Land Use <br /> Element designation of the General Plan from Medium <br /> Density Residential to Commercial and Offices (or <br /> to any other land use designation in the public <br /> interest) with respect to a site located at 3963 <br /> Stanley Boulevard, approximately one acre in size <br /> (Case GP-88-6); and <br /> <br />WHEREAS, within the time specified by the Pleasanton <br /> Municipal Code, Stanley Partners submitted an <br /> appeal to the City Clerk of the City of <br /> Pleasanton; and <br /> <br />WHEREAS, a public hearing was held before the City Council <br /> on December 20, 1988 at which time all relevant <br /> testimony was considered and all relevant documents <br /> were reviewed; and <br /> <br />WHEREAS, based on the preponderance of evidence, the City <br /> Council finds that this appeal and application <br /> should be granted because the property surrounding <br /> the subject property has changed to a more intense <br /> use and the subject property, in conjunction with <br /> adjacent properties, can be planned better if this <br /> general plan amendment is approved. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The appeal in Case GP-88-66, the application of <br /> Earl Augusta and Stanley Partners to amend the Land <br /> Use Element designation of the General Plan from <br /> Medium Density Residential to Commercial and <br /> Offices, with respect to a site located generally <br /> at 3963 Stanley Boulevard, approximately one acre <br /> in size, is GRANTED and the decision of the <br /> Planning Commission is REVERSED. <br /> <br /> <br />
