CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-576 <br /> <br /> ACCEPTANCE OF GRANT OF EASEMENT FOR STORM <br /> DRAIN FROM KRISTAN S. ANDERSON AND <br /> VACATION OF EXISTING PUBLIC SERVICE <br /> EASEME~ IN TRACT 5189, LOT 13 <br /> <br />WHEREAS, the City is in receipt of a deed from Kristan S. <br /> Anderson to the City of Pleasanton, a copy of which <br /> is attached hereto and incorporated herein by this <br /> reference, for purposes of a public service <br /> easement for a storm drain; and <br /> <br />WHEREAS, at its meeting of December 20, 1988, the City <br /> Council received a report from the Director of <br /> Public Works and Utilities (SR 579) indicating that <br /> the acceptance of this deed is in the public <br /> interest and recommending the vacation of the <br /> public service easement which was granted in Lot <br /> 13 by Grey Eagle; and <br /> <br />WHEREAS, the easement has been superseded by relocation and <br /> there are no other public facilities located within <br /> the easement; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The deed from Kristan S. Anderson to the City of <br /> Pleasanton for a public service easement for a <br /> storm drain is hereby accepted and the appropriate <br /> City officers are instructed to take whatever <br /> action necessary to implement said acceptance. <br /> <br />Section 2: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing <br /> that the public service easement is not required <br /> for public easement purposes pursuant to Section <br /> 8333(c) of the Streets and Highways Code, the <br /> public service easement described in Exhibit "A" is <br /> hereby vacated. <br /> <br />Section 3: The Clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the Office <br /> of the Alameda County Recorder. <br /> <br />Section 4: That from and after the date the resolution is <br /> recorded, the public service easement vacated no <br /> longer constitutes a public service easement. <br /> <br /> <br />
