CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-504 <br /> <br /> RESOLUTION DELEGATING CERTAIN AUTHORITY <br /> TO CITY ATTORNEY REGARDING TORT CLAIM <br /> <br /> WHEREAS, certain provisions of the California Tort Claims <br /> Act governs the procedures for presenting claims to <br /> local public entities; and <br /> <br /> WHEREAS, Government Code §935.4, which is part of the Tort <br /> Claims Act, provides tha~ a local public entity by <br /> resolution may authorize an employee of the local <br /> public entity to perform certain functions of the <br /> governing body concerning claims presented to the <br /> public entity, including authorizing the employee <br /> to deny claims and/or applications for late <br /> claims; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: The City Council hereby authorizes the City <br /> Attorney to perform the above-mentioned functions <br /> of the City Council concerning the <br /> denial/rejections of claims/applications for late <br /> claims, and any functions ancillary thereto. <br /> <br /> Section 2: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> THIS RESOLUTION ADOPTED OCTOBER 18, 1988 BY THE FOLLOWING <br /> VOTE: <br /> <br /> AYES: Councilmembers - Brandes, Butler, Wilson, and Mayor <br /> Mercer <br /> NOES: None <br /> ABSENT: Councilmember Mohr <br /> ABSTAIN: None <br /> <br />fiJames R.
