CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-502 <br /> <br /> RESOLUTION APPROVING THEAPPEAL OF A <br /> DECISION OF T~E DESIGN REVIEW BOARD <br /> DENYING THEAPPLICATION OF KEN GOOCH FOR <br /> DESIGN MEW APPROVAL TO CONSTRUCT <br /> FENCES GREATER THAN SIX FEET IN HEIGHT <br /> LOCATED AT 1608 MARTIN AVENUE AND 3616 <br /> NICHOT~ AVENUE (AP-88-25) <br /> <br />WHEREAS, at its meeting of September 28, 1988, the Design <br /> Review Board denied case Z-88-344, the application <br /> of Ken Gooch for design review approval to <br /> construct fences greater than six feet in height <br /> located at 1608 Martin Avenue and 36165 Nichole <br /> Avenue; and <br /> <br />WHEREAS, within the time specified by the Pleasanton <br /> Municipal Code, the applicant submitted an appeal <br /> to the City Clerk of the City of Pleasanton; and <br /> <br />WHEREAS, a duly noticed public hearing was held before the <br /> City Council on October 18, 1988 wherein all <br /> pertinent testimony and documents were reviewed; <br /> and <br /> <br />WHEREAS, after a review of the material presented, the City <br /> Council makes the following findings: <br /> <br /> a. That the proposed fences conform to the <br /> objectives of Chapter 18 of the Municipal <br /> Code; and <br /> <br /> b. That as approved, the fences assist in <br /> providing privacy, in attenuating sound <br /> transmission, and/or in reducing other <br /> annoyance from neighboring properties; and <br /> <br /> c. That the fences do not significantly impact <br /> upon the aesthetics and safety of the <br /> neighborhood nor the light and air to all <br /> affected properties. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the appeal of Ken Gooch to the decision <br /> of the Design Review Board and grants design review <br /> approval to construct fences greater than six feet <br /> in height located at 1608 Martin Avenue and 3616 <br /> <br /> <br />
