Page 4 TERMS AND CONDITIONS A. Payment for all services shall be due and payable on the date said services are performed. If said sum is not paid within thirty (30) days after the services that have been performed, an additional charge of 1 1/2% per month shall become due as an additional charge for the rendered services. No relationship shall exist between any payments to or due from other parties and payment due for services rendered. B. Client shall have a duty to advise the Consultants at the commence- ment of and during the study relative to the following items of which he may have knowledge, which may have a bearing on the factors being re- searched and conclusion(s) being formulated by the Consultants. The Consultants shall be the final judge of their appropriateness or inclusion in the study for the purposes intended, nor shall failure to ask for any item be considered an act of omission. 1. An accurate legal description. 2. Preliminary Title Report. 3. Leases; immediately past, present, and pending. 4. Income and expense statements; preferably for the last 3 years. 5. Proposed future rents and projected expenses. 6. Master Plan and/or Construction Plans. 7. Surveys which may be pertinent, i.e., Boundary, Topographical, Aerial, Soils, Subsoil, etc. 8. Structural Pest Control and other condition surveys. 9. Favorable or unfavorable actions by public agencies, rating bureaus, and boards responsible for industry standards. C. Abandonment or suspension of the Study shall not relieve the Client of monies due. The Consultants shall be paid for their services perform- ed, and all work and such extra work caused or on account of it shall be paid for at no less than usual daily charges plus expenses computed in our usual manner. D. Ownership of all file copies of calculations, photographs, and texts of reports, as instruments of service, under all circumstances is that of the Consultants.
