CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-478 <br /> <br /> RESOLUTION DENYING THEAPPEALOF A <br /> DECISION OF THE PLANNING COMMISSION <br /> APPROVINGTHEAPPLICATION OF RICHARD <br /> WOODRING FOR A CONDITIONAL USE PERMIT FOR <br /> CONSTRUCTION OF A SKATEBOARDRAMP <br /> (AP-88-22/UP-88-40) <br /> <br />WHEREAS, Richard Woodring applied for a conditional use <br /> permit to construct a skateboard ramp in the rear <br /> yard of the existing residence located at 1799 Peru <br /> Court; and <br /> <br />WHEREAS, the Planning Commission approved the application at <br /> its meeting of September 14, 1988; and <br /> <br />WHEREAS, this decision was appealed by the City Council so <br /> they could review the application; and <br /> <br />WHEREAS, a duly noticed public hearing was held by the City <br /> Council on October 4, 1988 at which time the <br /> applicant and any other member of the public was <br /> offered an opportunity to present evidence <br /> regarding this appeal; and <br /> <br />WHEREAS, after a review of the material presented, the City <br /> Council makes the following findings: <br /> <br /> a. That the proposed location of the conditional <br /> use is in accordance with the objectives of <br /> the zoning ordinance and the purposes of the <br /> district in which the site is located. <br /> <br /> b. That the proposed location of the conditional <br /> use and the conditions under which it would be <br /> operated or maintained will not be detrimental <br /> to the public health, safety, or welfare, or <br /> materially inferior to the properties or <br /> improvements in the vicinity. <br /> <br /> c. that the proposed ce~ditional use will comply <br /> with each of the applicable provisions of the <br /> Municipal Code regarding Conditional Uses. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council hereby denies AP-88-22, the <br /> appeal by the City Council of a decision of the <br /> <br /> <br />
