CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-194 <br /> <br /> RESOLUTION PERMITTING CITY OF PT~ASANTON <br /> TO JOINT IN AMICUS BRIEF <br /> <br />WHEREAS, there is pending in the Supreme Court of <br /> California, the matter of Pasadena POA v. City of <br /> Pasadena, in which the issue of when a police <br /> officer under investigation is entitled to <br /> materials pertaining to the investigation is to be <br /> decided; and <br /> <br />WHEREAS, an adverse ruling to the City of Pasadena may <br /> seriously impair the ability of police departments <br /> to conduct thorough internal affairs <br /> investigations; and <br /> <br />WHEREAS, the City Attorney's office of the City and County <br /> of San Francisco is writing the amici curiae <br /> (friends of the court) brief in which other cities <br /> may join at no cost; and <br /> <br />WHEREAS, the City Attorney and Police Chief of Pleasanton <br /> have recommended to the City Council that the City <br /> of Pleasanton be added to the amici curiae brief, <br /> at no out of pocket expense to the local <br /> taxpayers. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council hereby approves joinder of the <br /> City of Pleasanton in the amici curiae brief of the <br /> City and County of San Francisco in the case of <br /> Pasadena POA v. City of Pasadena, pending in the <br /> Supreme Court of California, such participation to <br /> be at no out of pocket expense to the City of <br /> Pleasanton. <br /> <br />Section 2: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
