LIN~TATZONS BERLOGAR GEOTECHNICAL CONSULTANTS provides services in the field of Soil Engineering Engineering Geology, in accordance with presently accepted professional practices. No warranty, either expressed or implied, is granted as part of performance of our work. For any damage on account of any error, omission or other professional negligence, our liability wilt be Limited to a sum of $50,000 or our fee, whichever is greater. In the event the CLient makes a claim against BERLOGAR GEOTECHNICAL CONSULTANTS at law or otherwise, for any alleged error, omission or other acts arising out of the performance of our professional services, and the CLient fails to prove such claim, then the Client shall pay all costs incurred by BERLOGAR GEOTECNNICAL CONSULTANTS in defending itself against the claim. BILLING Invoices will be issued every month, payable upon receipt, unless otherwise agreed. Client agrees to pay on receipt all invoices not questioned within 10 days after mailing by BERLOGAR GEOTECHNICAL CONSULTANTS. Any questions raised after this lO-day period will be answered by BERLOGAR GEOTECHNICAL CONSULTANTS and should any credit be due, BERLOGAR GEOTECHNICAL CONSULTANTS will apply the credit to future invoices, or if requested by CLient, refund any amount due. A service charge of 2 perce~t per month (but not exceeding the maximum rate allowable by Law) will be payable on any amounts not paid within 30 days, payment thereafter to be applied first to accrued interest and then to the principal unpaid amount. Any attorney~s fees or other costs incurred in collecting any delinquent amount shall be paid by the CLient.
