CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 89-184 ACCEPTANCE OF IMPROVEMENTS AND FURNISHINGS FORT HE GEORGE A. SPILIOTOPOULOS LIBRARY AND APPROVAL OF FINAL PROGRESS PAYMENTS TO BARRY SWENSON BUILDER AND APPROVAL OF SECOND CONTRACT AMENDMENT WITH CH2M HIT,T, TO FURNISH AS-BUILT DRAWINGS FOR THE LIBRARY AND COORDINATE WARRANTY WORK WHEREAS, work by Barry Swenson Builder, dba Green Valley Corporation, on the George A. Spiliotopoulos Library, has been satisfactorily completed; and WHEREAS, it is appropriate to authorize the final progress payments; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The work on the George A. Spiliotopoulos Library is hereby accepted. Section 2: The Director of Finance is instructed to prepare a warrant in the amount of $169,567.00 for the Library Improvements and $29,855.00 for the Library Furnishings in favor of Barry Swenson Builder, dba Green Valley Corporation, in satisfaction of the final progress payments for the above-accepted work on the Improvements and Furnishings for the George A. Spiliotopoulos Library. Five percent (5%) of the total contract, or $169,567.00 for the Library Improvements and $29,855.00 for the Library Furnishings, will be retained until thirty (30) days after filing the Notices of Completion. Section 3: The City Attorney is directed to file Notices of Completion with the Alameda County Recorder. Section 4: The City Council approves the Second Contract Amendment between the City of Pleasanton and CH2M Hill, Inc., to furnish as-built drawings for the Library and coordinate warranty work, a copy of which is attached hereto and incorporated herein by this reference. Section 5: Authorizes the City Manager to execute the above- described Second Contract Amendment.
