REIMBURSEMENT AGREEMENT FOR <br /> WATER MAIN IMPROVEMENTS <br /> <br /> THIS AGREEMENT is entered into at Pleasanton, <br />California, this day of April , 1989, by and <br />between the CITY OF PT~ASANTON, a general law city located in <br />Alameda County, California ("City") and J L CONSTRUCTION <br />COMPANY, a California corporation ("Developer") with <br />reference to the following facts. <br /> <br /> A. Developer is the owner of certain real property in <br />the City of Pleasanton, County of Alameda, State of <br />California, commonly known as "Canyon Meadows Development <br />Site," APN 941-1600-5-6 (the "Property"). Developer has <br />obtained City approval of a tentative subdivision map for a <br />244 unit condominium project to be constructed on the <br />Property. <br /> <br /> B. In connection with construction described above, <br />Developer is required to construct certain water main <br />improvements along the Dublin Canyon Road right-of-way. <br /> <br /> C. In order to obtain the proper amount of water flow <br />for the Developer's water main improvements, an approximately <br />740 foot 16" water main extension is required along Foothill <br />Road from Dublin Canyon Road to Deodar Way. <br /> <br /> D. In addition, the City has scheduled street overlay <br />work at Dublin Canyon/Foothill Road intersection for May <br />1990. <br /> <br /> E. In order to cause the least disruption to traffic <br />and to increase public safety at the subject intersection, <br />City has required the Developer to complete the 740 foot 16" <br />water main extension at this time. <br /> <br /> F. In order to resolve any potential disputes about <br />responsibilities for these public improvements, the City has <br />agreed to reimburse contractor as stated in this Agreement <br />for said 16" water main improvements between Dublin <br />Canyon/Foothill and Deodar/Foothill intersections. <br /> <br /> NOW, THEREFORE, IT IS AGREED as follows: <br /> <br /> 1. Improvements. Developer shall construct a 16" <br />water main along Foothill Road between Foothill/Dublin Canyon <br />Road intersection and Foothill/Deodar Way intersection, as <br />more particularly shown on City approved construction plans <br />as drafted by the engineering firm of Brian, Kangas and <br />Foulk, dated March 1989, which are incorporated herein as if <br />fully set forth. <br />2. Reimbursement Costs. Developer is entitled to <br />recover the costs of such construction work from the City of <br /> <br /> -1- <br /> <br /> <br />
