CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-178 <br /> <br /> RESOLUTION AUTHORIZING SETTLRMENT OF <br /> AMADOR VAT~Y SAVINGS AND LOAN, ETALv. <br /> CITY OF PT~ASANTON <br /> <br />WHEREAS, there is pending in the Superior Court of the <br /> County of Alameda, Case No. H-139023-6, Amador <br /> Valley Savings and Loan Association, et al. v. City <br /> of Pleasanton, et al., wherein petitioners seek a <br /> writ of mandate to require the City to set aside a <br /> height limitation in the Vintage Heights II <br /> subdivision, and damages; and <br /> <br />WHEREAS, the parties, through their respective attorneys, <br /> have negotiated a proposed resolution of this <br /> litigation; and <br /> <br />WHEREAS, on March 21, 1989, the City Council indicated its <br /> tentative approval of a negotiated settlement, <br /> subject to the final settlement documents being <br /> found to be acceptable to the City Council; and <br /> <br />WHEREAS, the City Council has reviewed a proposed Agreement, <br /> Stipulation, Judgment and Declaration, and found <br /> these documents to be generally acceptable, subject <br /> to final approval by the City Attorney; and <br /> <br />WHEREAS, in part, these documents, if approved by all <br /> concerned parties, <br /> <br /> 1. Will permit the construction on Lots 1-4, 6-13 <br /> of the Vintage Heights II subdivision single <br /> story houses with the following maximum height <br /> limitations: (a) Lot 1: 21 feet; (b) Lot 2: <br /> 21 feet; (c) Lot 3: 21 feet; (d) Lot 4: 24.5 <br /> feet; (e) Lot 6: 25 feet; (f) Lot 7: 20 <br /> feet; (g) Lot 8: 25 feet; (h) Lot 9: 24.5 <br /> feet; (i) Lot 10: 19 feet; (j) Lot 11: 24.5 <br /> feet; (k) Lot 12: 22 feet; (1) Lot 13: 22 <br /> feet. The maximum height shall be measured <br /> from the highest point on the pad elevation of <br /> each lot to the top of the roof ridge line, <br /> and as to each house, the top of the roof <br /> ridge line shall be at least five feet away <br /> from the plane created by the rear wall of <br /> that house; and <br /> <br /> <br />
