WHEREAS, the area is not w~th~n an agricultural preserve, and the - property owner has consented to the annexation; and ~HEREAS, at the hearing on March 16, ]989, the Local Agency Formation Commission heard and received all oral and written protests, objections and evidence which were made, presented or filed, and all persons present were given an opportunity to appear and be heard in respect to any matter relating to said application ahd report; and WHEREAS, this Commission did find as follows: ], The proposal is consistent w~th the procedures and policies previously adoptedby the Commission. The annexation w~ll permit the provision of munlctpa] services to the subject area, 3, Pursuant to the California Environmental Quality Act, a Negative Declaration has been adopted by the City of Pleasanton as lead agency, and said Negative Declaration has been considered by the Commission; and 4, No significant impacts or mitigation measures of concern as a responsible agency were identified in the Negative Declaration, NON, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED THAT: AnnexLion No, 120 to the City of Pleasanton be approved subject to the following conditions: l, Correction of the map and description as may be required by the Director of Public Works, ex-offlclo County Surveyor; and 2, The City be authorized to proceed without notice or hearing, I CERTIFY THAT THE FOREGOING IS A COR~'~CT CO2Y O?
