CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-148 <br /> <br /> RESOLUTION AUTHORIZING SETTI,F~fENT OF <br /> GLASGOW v. CITY OF PI./ASANTON <br /> <br />WHEREAS, there is pending in the Superior Court of the <br /> County of Alameda, Case No. H-131029-1, Glasqow v. <br /> City of Pleasanton, wherein plaintiff seeks an <br /> award of damages for personal injuries sustained in <br /> an automobile accident that occurred on May 6, 1987 <br /> on Santa Rita Road; and <br /> <br />WHEREAS, on February 21, 1989, the City Attorney requested <br /> additional settlement authority from the City <br /> Council in an effort to resolve this case without <br /> going to trial, which authority was granted; and <br /> <br />WHEREAS, the City Attorney, special defense counsel, and the <br /> City Claims Administrator, have all recommended <br /> that the City settle this case for the sum of <br /> $55,000, in exchange for a release of all claims <br /> and dismissal of the above-captioned action with <br /> prejudice; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Attorney and special defense counsel are <br /> authorized and directed to settle this action with <br /> the plaintiff, Gary M. Glasgow, in the amount of <br /> Fifty-five Thousand Dollars ($55,000.00) <br /> <br />Section 2: The appropriate City officials are authorized and <br /> directed to execute and deliver all settlement <br /> documents, drafts, and other papers necessary to <br /> consummate this settlement on the terms expressed <br /> herein. <br /> <br />Section 3: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
