METROPOLITAN TRANSPORTATION COMMISSION (MTC) PAVEMENT MANAGEMENT SYSTEM (PMS) LICENSE AGREEMENT Read this agreement carefully before using the Pavement Management Systems (PMS) diskettes or video tapes. Regardless of whether or not you sign this license agreement, using the PMS diskettes or video tapes in any manner means that you accept the terms of this license agreement. The terms of this license agreement apply to you as the original ltcensee and to any subsequent ]icensee of this Pavement Management Systems software or video tapes. If you agree to the terms of the license agreement, sign where indicated and return the executed ]icense agreement to MTC at the address set forth below. If you do not accept or agree to the terms of the license agreement, you may return the . thin 10 days after de]tvery for a refund of the purchase price of the software or video tapes, less mailing costs. All diskettes and video tapes must be returned to MTC, and no copies of any PMS software or video tapes may be retained. The Metropolitan Transportation Commission retains the ownership of all copies of Pavement Management Systems software and video tapes. This copy of PMS software or video tape is licensed to you for use under the following conditions: PERMITTED USES/YOU MAY: 1. Use PMS software on any compatible computer, provided the PMS software is used on only one computer and by one user at a time. 2. Install PMS software on a hard disk and use it without an authorization device, in accordance with the instructions in the documentation. 3. Transfer PMS software or video tapes to another party if the other party agrees to the terms and conditions of the MTC License Agreement and completes and returns a Transfer of License Form to MTC. A Transfer of License Form may be obtained by writing to MTC, Attention: Planning Section. If you transfer PMS software, you must at the same time transfer the documentation and all disks. PROHIBITED USES/YOU MAY NOT, without the express written permi s s i on from the Metropol i tan Tran s portat i on Commi s s i on: 1. Make copies of any of the PMS documentation or the PMS System Disk or Backup Disk, except in the manner described in the PMS instructions. 2. Make copies of any of the PMS video training tapes. 3. Distribute, rent, sublicense or lease the PMS software, documentation or video tapes. 4. Alter, modify or adapt PMS software or documentation, including, but not limited to, translating, decompiling, disassembling or creating derivative works. 5. Use PMS software on a computer system or work station where an authorization device is not employed, unless installed on a hard disk in accordance with the instructions in the documentation. This License and your right to use the PMS software and/or video tapes automatically terminates if you fail to comply with any provision of this License Agreement.
