PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2424 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON INITIATING AN APPLICATION FOR <br />A CHANGE TO THE ORDINANCE CODE RELATING TO DAYCARE <br />FACILITIES IN SINGLE-FAMILY RESIDENTIAL DISTRICTS <br />AND RECOMMENDING APPROVAL OF THE APPLICATION AS <br />FILED UNDER CASE RZ-84-1 <br />WHEREAS, at their duly noticed public hearing of January 25, 1984 <br />the Planning Commission, after considering recommendations <br />of the City staff, initiated a change to the Ordinance <br />Code relating to daycare facilities in residentially zoned <br />areas; and <br />WHEREAS, at this same duly noticed public hearing, the Planning Commission <br />considered all public testimony, relevant exhibits and <br />recommendations of the City Staff; and <br />WHEREAS, the Planning Commission felt that the recommendations of <br />the City Staff providing for administrative review of requests <br />for daycare facilities according to the basic standard that <br />such operations be separated by three hundred feet from <br />any other child care facility; where an applicant's home <br />is closer than three hundred feet to another childcare facility, <br />as provided for under state law, a maximum of six children <br />(including those residing in the home) could be cared for <br />is appropriate for the City of Pleasanton. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Recommends that the Zoning Ordinance be amended with <br />respect to regulation of childcare facilities for twelve <br />or fewer children in residential areas as provided for in <br />Articles 5 (R-1 One Family Residential Districts) and Article <br />6 (RM Multi-family Residential Districts) to provide for <br />adminsitrative use permits for such childcare facilities <br />as recommended by the City staff. <br />Section 2. This resolution shall become effective immediately upon <br />its passage and adoption. <br />PASSED AND ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />ON THE 25TH DAY OF JANUARY 1984 BY THE FOLLOWING VOTE: <br />AYES: Commissioners Doherty, Getty, Lindsey and Chairman Jamieson <br />NOES: Commissioner Wilson <br />ABSENT: None <br />ABSTAIN: None <br />DATE: January 25, 1984 <br />
