PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2425 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON RELATING TO A ONE YEAR REVIEW OF CASE <br />UP-82-24, A CONDITIONAL USE PERMIT FOR JAMES CROSS <br />AND TEXACO, INC. <br />WHEREAS, Condition No. 20 of Resolution No. 2258, approving case <br />UP-82-24, the use permit granted for the operation of <br />the automobile service center in the former Texaco Service <br />Station located at 44 Mission Drive, states that the use <br />permit shall be reviewed one year from the date of operation <br />of the service center and that the Planning Commission <br />shall have the ability to add, delete, or modify conditions <br />of the use permit at that time; and <br />WHEREAS, the service center began operation some time around February <br />1983 and for this reason UP-82-24 is being submitted for <br />Commission review on January 25, 1984; and <br />WHEREAS, the Planning Commission concurs with the staff's opinion <br />that Mr. Cross is in conformance with all of the required <br />conditions of his use permit and there is no need to add <br />to, modify or delete any of these conditions as long as <br />Mr. Cross is the owner/operator of the business. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. The Planning Commission finds that Mr. Cross is in <br />compliance with the conditions of the use permit granted <br />under case UP-82-24 and therefore allows him to continue <br />operation for three additional years as long as he is <br />the owner/operator of the business, at which time, per <br />Condition No. 3, it will be necessary for him to renew <br />the use permit. Should Mr. Cross not remain the owner/operator <br />of the business at 44 Mission Drive and sells the business <br />to others, this use permit shall be subject to an annual <br />review for the purpose of determining whether or not the <br />use is in conformance with all of the required conditions <br />of approval of case UP-82-24. The Planning Commission <br />shall have the ability to add, delete, or modify conditions <br />of the use permit if subject to an annual review.. <br />Section 2. This resolution shall become effective the day after <br />notification of the City Council. <br />PASSED AND ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />ON THE 25TH DAY OF JANUARY 1984 BY THE FOLLOWING VOTE: <br />AYES: Commissioners Doherty, Getty, Lindsey and Chairman Jamieson <br />,- NOES: Commissioner Wilson <br />ABSENT: None <br />ABSTAIN: None <br />DATE: January 25, 1984 <br />
