PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2494 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON APPROVING A CONDITIONAL USE <br />PERMIT FOR HOPYARD PRESCHOOL AS FILED UNDER CASE <br />UP-84-24 <br />WHEREAS, Hopyard Preschool has applied for a conditional use <br />permit to enlarge an existing preschool from 60 to <br />120 children located at 1251 Hopyard Road; and <br />WHEREAS, at their duly noticed public hearing of July 11, 1984 <br />the Planning Commission approved a negative declaration <br />of environmental impacts for this proposal after considering <br />all public input, relevant documents and recommendations <br />of the City Staff; and <br />WHEREAS, the Planning Commission found that the proposed location <br />of the conditional use is in accord with the objectives <br />of the zoning ordinance and purposes of the district <br />in which the site is located; that the proposed location <br />of the conditional use and the conditions under which <br />it would be operated or maintained would not be detrimental <br />to the public health, safety or welfare, or be materially <br />injurious to properties or improvements in the vicinity; <br />and that the proposed conditional use will comply with <br />each of the applicable provisions of the ordinance. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves case UP-84-24, application of Hopyard Preschool <br />to enlarge an existing preschool from 60 to 120 children <br />located at 1251 Hopyard Road subject to the following <br />conditions: <br />1. That this use permit is granted to operate a preschool <br />for a maximum of 120 children on the property located <br />at 1251 Hopyard Road. <br />2. That the applicant apply for and secure licensing <br />for the school from the State of California and <br />any other required licensing agencies. <br />3. That prior to in any way increasing the size of <br />the preschool,the applicant shall furnisE: the City <br />of Pleasanton with a copy of a perpetual nonrevokable <br />easement for access and parking purposes which <br />indicates that the nursery school has exclusive <br />use of at least 20 parking spaces in the church <br />parking lot during all hours of operation of the <br />" school; said easement to be recorded in accordance <br />with the requirements of §2-9.23, Article 16, Chapter <br />2, Title II of the Ordinance Code of the City of <br />Pleasanton. <br />
