City shall not charge the Owner for standard City <br /> service connection fee, meter installation cost, engineering <br /> costs, any installation costs, and plan check fees. <br /> <br /> 2. Property Subdivision. If Owner's property is <br />subdivided, the Owner shall only receive free water service <br />for the existing single family residence and subject to the <br />condition that Mrs. Bonde or her immediate heirs reside at <br />the subject residence and as stated in Paragraph 1 above. <br /> <br /> 3. Notices. All notices herein required shall be in <br />writing and delivered in person or sent by certified mail, <br />postage prepaid. Notices required to be given to City shall <br />be addressed as follows: <br /> <br /> City Manager <br /> City of Pleasanton <br /> 123 Main Street <br /> P. O. Box 520 <br /> Pleasanton CA 94566 <br /> <br />Notices required to be given to Owner shall be addressed as <br />follows: <br /> <br /> Mrs. Roselma Bonde <br /> 4100 Bernal Avenue <br /> Pleasanton CA 94566 <br /> <br /> 4. Waiver. In the event that either City or Owner <br />shall at any time or times waive any breach of this agreement <br />by the other, such waiver shall not constitute waiver of any <br />other or succeeding breach of this agreement, whether of the <br />same or any other covenant, condition or obligation. <br /> <br /> 5. Binding on Land and Successors. All covenants, <br />promises and agreements contained in this agreement shall <br />pertain to and do hereby expressly run with the land <br />controlled by Owner and described herein. This agreement <br />shall bind and inure to the parties hereto, including heirs, <br />assigns, executors, administrators, and all other parties <br />whether they succeed by operation of law or voluntary acts of <br />Owner. Signatures and execution of all parties shall be <br />acknowledged before a Notary Public. The City shall record <br />this agreement with the Recorder of Alameda County. <br /> <br /> -2- <br /> <br /> <br />
