CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 89-98 APPROVAL OF CERTIFICATE OF COMPLIANCE WITH DEVELOPMENT AGREEMENTS FOR HACIENDA BUSINESS PARK PHASES I AND II WHEREAS, pursuant to the terms of the development agreements with Prudential Insurance Company of America and Callahan Pentz Properties, an annual review of the progress of development of the subject project is required by Government Code §65865.1 to confirm compliance with the terms f the agreements; and WHEREAS, the City has received the required submittals from both Prudential and Callahan which demonstrate the developers' good faith compliance with the terms and conditions of the Development Agreements for Hacienda Business Park, Phase I and Phase II; and WHEREAS, the City Council hereby makes the following findings: a. The actions, programs of public works construction, economic investments, policies, and technical and legal analyses undertaken in fulfillment of the Development Agreements are hereby found to comply with the terms of the Phase I development agreement in that they satisfy each of the general objectives and specific requirements set forth in the Phase I Development Agreement that applied to Phase I during the interval commencing March 1, 1988 and ending February 28, 1989. b. The actions, programs of public works construction, economic investments, policies, and technical and legal analyses undertaken in fulfillment of the Development Agreements are hereby found to comply with the terms of the Phase II Development Agreement that applied to Phase II during the interval commencing March 1, 1988 and ending February 28, 1989. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the proposed Certificate of Compliance for Phases I and II, Hacienda Business Park development Agreement.
