CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 89-95 RESOLUTION ADDING AGENDA ITEM REGARDING AMENDING BID DOCUMENTS CONCERNING THE STONERIDGE INTERCHANGE CONSTRUCTION PROJECT WHEREAS, City Council has previously approved the plans and specifications, including bid documents, for the Stoneridge Interchange Construction Project; and WHEREAS, because of the importance of this interchange, staff has recommended that a resolution be adopted to amend the bid documents to include an incentive clause to the contractor to whom the bid is awarded; and WHEREAS, consideration of such a resolution was not set forth on the City Council agenda for March 7, 1989, because information from Caltrans concerning whether such a clause could be added to the bid documents was not available until after the March 7, 1989 agenda was posted; and WHEREAS, the Brown Act permits the Council to add an item to the agenda upon a two-thirds vote of the Council that the item arose after the time the agenda was posted; and WHEREAS, whether to adopt a resolution to authorize amending the bid documents to include an incentive clause is a critical decision for this Project because the bids are to be opened on March 21, 1989, before the City Council meets again. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Based on the findings set forth above, a resolution to consider amending the bid documents to include an incentive clause for the Stoneridge Interchange Construction Project is hereby added to the March 7, 1989 agenda for Council consideration and action, if necessary. Section 2: This resolution shall become effective immediately upon its passage and adoption.
