CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-95 <br /> <br /> RESOLUTION ADDING AGENDA ITEM REGARDING <br /> AMENDING BID DOCUMENTS CONCERNING THE <br /> STONERIDGE INTERCHANGE CONSTRUCTION <br /> PROJECT <br /> <br />WHEREAS, City Council has previously approved the plans and <br /> specifications, including bid documents, for the <br /> Stoneridge Interchange Construction Project; and <br /> <br />WHEREAS, because of the importance of this interchange, <br /> staff has recommended that a resolution be adopted <br /> to amend the bid documents to include an incentive <br /> clause to the contractor to whom the bid is <br /> awarded; and <br /> <br />WHEREAS, consideration of such a resolution was not set <br /> forth on the City Council agenda for March 7, <br /> 1989, because information from Caltrans concerning <br /> whether such a clause could be added to the bid <br /> documents was not available until after the <br /> March 7, 1989 agenda was posted; and <br /> <br />WHEREAS, the Brown Act permits the Council to add an item to <br /> the agenda upon a two-thirds vote of the Council <br /> that the item arose after the time the agenda was <br /> posted; and <br /> <br />WHEREAS, whether to adopt a resolution to authorize amending <br /> the bid documents to include an incentive clause is <br /> a critical decision for this Project because the <br /> bids are to be opened on March 21, 1989, before the <br /> City Council meets again. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Based on the findings set forth above, a <br /> resolution to consider amending the bid documents <br /> to include an incentive clause for the Stoneridge <br /> Interchange Construction Project is hereby added to <br /> the March 7, 1989 agenda for Council consideration <br /> and action, if necessary. <br /> <br />Section 2: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
