40. That no improvement activities, including but not limited <br />to grading, construction, tree removal or site preparation <br />shall be initiated until all proper permits are obtained. <br />41. That a fire retardant buffer 10 ft. in width shall be <br />provided along the length of both sides of the Twelve Oaks <br />Drive private roadway and any other street or driveway <br />required by the Fire Department and be engineered and <br />landscaped in such a way as to minimize erosion to a <br />level acceptable to the City Engineer. <br />42. That street lighting shall be provided by the developer <br />and shall be designed to minimize intrusion of hillside <br />lighting to the valley floor as concurred with by the <br />City Planning Division. The lighting system on the <br />private road shall be approved by the City Engineer, <br />installed by the developer and maintained by the <br />homeowners association. <br />43. That the deed restrictions for each lot indicate to <br />potential buyers the responsibility of the owners for <br />maintenance and repair of all common areas, roadways <br />and private utility and service systems. <br />44. That the fire hydrant and water system be designed to <br />provide a water flow of 1500 gpm. <br />45. That the fire hydrants and other Fire Department con- <br />nections shall be located and sized as directed by the <br />City Fire Chief. <br />46. That 20 ft. wide fire retardant buffers shall be provided <br />around all structures on the sites on Twelve Oaks Drive <br />cul-de-sac. <br />47. That all exterior roofing and siding of all structures <br />shall be fire retarding. <br />48. That all landscaping of the site complement the natural <br />setting and limit the use of water for irrigation in <br />order to minimize water saturation. <br />49. That all private roadways and private utility systems on <br />the project site shall be owned, maintained, and repaired <br />and operated by the homeowners association. <br />50. That prior to the filing of a final map, the CC&RS for <br />the project shall be approved by the City Attorney. The <br />CC&RS shall provide for a homeowners association with <br />sufficient power to manage the common open space areas, and <br />operate and maintain all commonly owned areas and facilities. <br />The budget, bylaws, and accounting systems shall also receive <br />City staff approval before a final map may be filed. <br />
