PLANNING COMMISSION <br />CITY OF PLEASANTON <br />_ COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2220 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY <br />OF PLEASANTON RECOMC4ENDING A ZONING CHANGE FOR <br />DEVCON CONSTRUCTION AS FILED UNDER CASE PUD-82-18 <br />WHEREAS, Devcon Construction, Inc. has applied to rezone an <br />approximately 14 acre site on the west side of Rheem <br />Drive between Trenery Drive and Mohr Avenue from the <br />IP (Industrial Park) to the PUD (Planned Unit <br />Development)-Industrial District; and <br />WHEREAS, this application is being filed to allow the developer <br />greater flexibility with regard to setbacks and <br />other site development criteria. As part of this <br />application, they are not asking that the uses currently <br />allowed on the property be changed in any manner; and <br />WHEREAS, no request is being made for development plan approval, <br />but the rezoning request will allow them to have more <br />imaginative designs for the sites; and <br />WHEREAS, since the proposed rezoning would not change the land <br />uses allowed on the property and would effect only the <br />site development standards within a narrow range, this <br />project is deemed to be exempt from CEQA (.under Class 5 <br />relating to minor alterations to land use limitations); and <br />WHEREAS, a duly noticed public hearing was held on September 21, <br />1982, at which time the public was afforded the opportunity <br />to comment on this application; and <br />WHEREAS, Planned Unit Development zoning is in conformance with <br />the General Plan of the City of Pleasanton and the <br />purposes of the Planned Unit Development zoning district. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES THE FOLLOWING: <br />Section 1. Recommends the 14 acre site located on the west side <br />of the future Rheem Drive between Trenery Drive and the <br />J. A. Jenks spice plant site be rezoned from the I-P <br />(Industrial Park) District to the PUD (Planned Unit <br />Development)-Industrial District and that the uses <br />allowed be those of the I-P (Industrial Park) District <br />subject to the conditions shown on Exhibit "A" attached <br />hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective immediately <br />upon its passage and adoption. <br />
