PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUPdTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2223 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON DENYING CASE PUD-82-17, <br />APPLICATION OF RICHARD HEMPY ET AL <br />WHEREAS, Richard Hempy et al have applied for Planned Unit <br />Development (PUD) development plan approval for a <br />four lot residential subdivision of approximately <br />4.35 acres of land located on the west side of <br />Foothill Road at and adjacent to the south of 5050 <br />Foothill Road; and <br />WHEREAS, zoning for the property is PUD (Planned Unit Development)- <br />Low Density Residential District; and <br />WHEREAS, a duly noticed public hearing was held September 21, <br />1982 at which time public testimony and pertinent <br />documents were considered for this application; and <br />WfiEREAS, this matter was continued to October 13, 1982 to give <br />_ the property owners time to consider the imposition <br />of the public improvement conditions proposed in the <br />staff report; and <br />WHEREAS, at the continued public hearing o£ October 13, 1982 <br />the property owners discussed the requirement of the <br />City for dedication or deferment agreement for <br />public improvements and found they could not comply. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CI^1Y OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Denies the application of Richard Hempy et al <br />for Planned Unit Development (PUD) development plan <br />approval for a four lot residential subdivision of <br />approximately 4.35 acres of land located on the west <br />side of Foothill Road at and adjacent to the south <br />of 5050 Foothill Road. <br />Section 2. This resolution shall become effective immediately <br />upon its passage and adoption. <br />PASSED AND ADOPTED by the Planning Commission of the City of <br />Pleasanton on the 13th day of October 1982 by the following <br />vote: <br />
