PLANNING COMMISSION <br />CITY OF PLEASANTON <br />,_ COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2224 <br />A RESOLUTION OF THE PLANNING COMIIISSIOIV OF THE <br />CITY OF PLEASANTON APPROVING THE NEGATIVE DECLARATION <br />PREPARED FOR CASE UP-82-16 FILED BY ROBERT R. KENNY <br />WHEREAS, Robert R. Kenny has applied to operate a public auction <br />facility at 3440 Stanley Blvd., specializing in used <br />furniture, appliances and antiques; and <br />LQHEREAS, zoning for the property is C-S (Commercial Service) <br />District; and <br />WHEP.EAS, at their meeting of October 13, 1982 the Planning <br />Commission received a proposed negative declaration for <br />case UP-82-16; and <br />WHEREAS, the Planning Commission has received and reviewed the <br />Initial Study dated October 13, 1982 and received the <br />recommendation of the staff; and <br />WHEREAS, a duly noticed public hearing was held on October 13, 1982 <br />and the public was given the opportunity to comment on the <br />environmental impacts of the proposed conditional use; and <br />WHEREAS, the Planning Commission has reviewed the potential impacts <br />in accordance with the applicable state and local <br />guidelines governing the preparation of negative <br />declarations and environmental impact reports; and <br />WIIEREAS, the Initial Study prepared by the City staff indicated <br />there would not be any significant impacts upon the <br />environment by approving the conditional use permit and <br />Negative Declaration for this case. <br />IdOLQ, TIiEREFORE, THE PLANNING COMMISSIOid RESOLVES TIIE FOLLOWING: <br />Section 1. The Planning Commission finds that based upon the <br />review of the Initial Study and the testimony and <br />documentary evidence presented at the public hearing that <br />there will be no significant adverse impacts upon the <br />environment as a result of the approval of the conditional <br />use permit for the subject property. <br />Section 2. Approves the negative declaration prepared for case <br />UP-82-16, application for a conditional use permit as <br />described above. <br />
