PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAPZEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2225 <br />A RESOLUTION OF THE PLANNING COPM~IISSION OF THE CITY OF <br />PLEASAIdTON APPROVING A CONDITIONAL USE PERMIT FOR <br />ROBERT R. KENNY AS FILED UNDER CASE UP-82-16 <br />WHEREAS, Robert R. Kenny has applied to operate a public auction <br />facility at 3440 Stanley Blvd., specializing in used <br />furniture, appliances and antiques; and <br />WHEREAS, a duly noticed public hearing was held on October 13, 1982 <br />at which time all pertinent documents and public testimony <br />were considered; and <br />WHEREAS, at this duly noticed public hearing the Planning Commission <br />approved a Negative Declaration of Environmental Impacts <br />for case UP-82-16; and <br />WHEREAS, the Planning Commission found that the proposed location <br />of the conditional use is in accord with the objectives <br />of the zoning ordinance~artcpurposes of the district in which <br />the site is located; and <br />WHEREAS, the Planning Commission found that the proposed location <br />of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental <br />to the public health, safety or welfare or be materially <br />injurious to properties or improvements in the vicinity; and <br />SVHEREAS, the Planning Commission found that the proposed conditional <br />use will comply with each of the applicable provisions <br />of Chapter 2, Title II of the Zoning Ordinance. <br />NOW, TIIEREFORE, THE PLANNING COMMISSION RESOLVES THE FOLLOWING: <br />Section 1. Approves case UP-82-16, application of Robert R. Kenny <br />for a public auction facility at 3440 Stanley Blvd., <br />specializing in used furniture, appliances and antiques <br />subject to the following conditions: <br />1. That the auction take place only in the front 4100 <br />sq. ft. area of the building located at 3440 Stanley <br />Boulevard and shall consist of the sale of furniture, <br />appliances and antiques only. <br />2. That seating for the auction shall be limited to 100 <br />seats and held not oftener than one evening during <br />the week and not before the hour of 7:OOpm <br />3. That all requirements of the Fire and Building Departments <br />shall be met prior to the beginning of operation. <br />
