EXHIBIT "A" <br />Planning Commission Resolution No. 2227 <br />Case PUD-82-,20 <br />1. That the development be substantially as shown on the <br />development plan, Exhibit A, on file with the Planning <br />Division except that the units shall be reduced by six. <br />2. That one of the compact car spaces shown in front of <br />the buildings containing apartment number 18 and 30 <br />shall be removed to provide better fire access to that <br />structure. <br />3. That the north/south street through. the subject property <br />shall not be called Birch Creek Drive, but shall either <br />be Amador Way or Vine Street and that a final decision <br />of the name shall be approved by the staff. <br />4. That all units shall be maintained as apartments and <br />shall be rented for a period of not less than ten (10) <br />years. <br />5. That approval of case PUD-82-20 shall not become <br />effective until ninety (90) days after the small <br />project allocation of the Growth Management Plan has <br />taken place for 1983 and during that 90 day period the <br />applicant may apply to the City Council to rescind its <br />approval of case PUD-82-20, in which event case PUD-81-32 <br />would remain in full force and effect. <br />6. That colors for all structures be submitted to the <br />Planning Division for approval prior to issuance of <br />a building permit. <br />7. That a final landscape plan be submitted to the <br />Planning Division for approval prior to issuance of <br />a building permit. <br />8. That except as modified by the development plan, all <br />site development standards shall be those of the <br />RM-2500 District. <br />9. That the development shall meet all the requirements <br />of the City Fire Code. <br />10. That prior to the filing of a final map on the subject <br />property, CC&Rs for the project shall be approved by <br />the City Attorney. These CC&Rs shall provide for a <br />homeowners association with sufficient power to manage <br />all commonly owned areas. The City shall be named as <br />beneficiary of said CC&Rs and granted the power to <br />enforce its provisions if the homeowners association <br />fails to do so. <br />A-1 <br />
