PLANNING COM[~4ISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 2269 A RESOLUTION OF THE CITY OF PLEASANTON APPROVING A USE PERMIT FOR MORRISON HOMES CORPORATION AS FILED UNDER CASE UP-83-3 WHEREAS, Morrison Homes Corporation has filed for a conditional use permit to operate a four lot model home sales complex and a temporary sales trailer on the east side of Kolln Street at its intersection with Orloff Drive (Lots 1-4 & 58, Tract 4890); and WHEREAS, zoning for the property is PUD (Planned Unit Development)- Medium Density Residential District; and WHEREAS, at their duly noticed public hearing of February 23, 1983 the Planning Commission considered all public tes*_imony, related exhibits and recommendations of the City Staff; and WHEREAS, the Planning Commission found that the proposed location of the conditional use is in accord with the objectives of this chapter and the purposes of the district in which the site is located; and WHEREAS, the Planning Commission found that the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity; and WHEREAS, the Planning Commission found that the proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves case UP-83-3, application of Morrison homes to operate a four lot model home sales complex and a temporary sales trailer on the east side of Kolln Street at its intersection with Orloff Drive subject to the conditions shown on Exhibit "A", attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days following the date on which the use permit was granted or on the day following the next meeting of the Council, whichever is later, unless an appeal has been taken to the Council or unless the Council shall elect to review the decision of the Commission.
