That the development be substantially as shown on the <br />development plan, Exhibit A, on file with the Planning <br />Division. <br />2. That the developer be aware that growth management <br />approval must be granted prior to submittal of a <br />tentative map on the subject property. <br />3. That the developer enter into an agreement to pay for <br />a proportionate share of the water facilities necessary <br />to properly serve the southeast Pleasanton area and the <br />Vintage Hills area. These facilities shall be those <br />as generally described in the report "Water Demand and <br />Preliminary Facilities Study for East Pleasanton, prepared <br />by Kamp, Dresser and McKee, Inc., January 1983," and <br />additional facilities necessary to create a loop water <br />system for the southeast Pleasanton and Vintage Hills <br />areas. All water fees necessary for this purpose shall <br />be paid prior to approval of the final subdivision map <br />for the subject area. <br />4. That no structure shall be built outside of the area shown <br />as "Building Pad" on the development plan, Exhibit A with <br />the exception of open type fencing approved by the Planning <br />Division, <br />5, That the colors and building materials for all homes <br />shall be submitted to the Planning Division prior to <br />issuance of a building permit, <br />6, That a site specific soils study shall be done for <br />each lot and that these studies shall be submitted to <br />the City for review and approval prior to issuance of <br />building permits, <br />7, That if a homeowners association is established <br />for the development, That the CC&Rs for the homeowners' <br />association shall be submitted to the City for review <br />and approval prior to submittal of a final map and <br />that the City shall be named as third party beneficiary <br />of the CC&Rs and granted the power to enforce their <br />provisions if the homeowners' association fails to do so. <br />A-1 <br />
