PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2288 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF PLEASANTON APPROVING A MODIFICATION <br />TO THE CONDITIONAL USE PERMIT FOR THE <br />AUCTION FACILITY AT 3440 STANLEY BOULEVARD <br />FILED UNDER CASE UP-62-16 <br />WHEREAS, Robert Kinney, the operator of an auction facility <br />located at 3440 Stanley Boulevard has been successful <br />in his business endeavors at the location described <br />herein and is desirous of expanding his business <br />to allow for more than the one Wednesday evening each <br />week to hold auctions; and <br />WHEREAS, "there has been no complaints lodged against <br />his business activities to the City to date; and <br />WHEREAS, at their duly noticed public hearing of April 13, 1983 <br />the Planning Commission considered testimony by <br />Mr. Kinney's representative and considered comments <br />by the City staff that the entire use permit would <br />come before the Planning Commission in October 1983 <br />for review. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves the request for a modification to case <br />UP-82-16 subject to the following condition: <br />1. That seating for auctions shall be limited to <br />100 seats and that auctions shall be held no more <br />often than one evening during the week, not <br />before 7:OOpm and on no more than two other <br />occasions during any calendar month at times to be <br />approved by the Planning Staff. This condition <br />shall be reviewed in October 1983 as part of <br />case UP-82-16. <br />Section 2. This resolution shall become effective immediately <br />upon its passage and adoption. <br />PASSED AND ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON ON THE 13TH DAY OF APRIL 1983 BY THE FOLLOWING VOTE: <br />AYES: Commissioners Doherty, Getty, Jamieson, Wilson and <br />Chairperson Lindsey <br />_ NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />
