PLANNING COMMISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION N0. 2292 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON APPROVING A CONDITIONAL USE PERMIT FOR EARL AND BARBARA ADAMS AS FILED UNDER CASE UP-83-6 WHEREAS, Earl and Barbara Adams have applied for conditional use permit approval to operate a 2350 sq. ft. restaurant at 3657 Old Santa Rita Road; and WHEREAS, zoning for the property is C-S (Commercial Service) District; and WHEREAS, at their duly noticed public hearing of April 13, 1983 the Planning Commission considered all public testimony, pertinent exhibits and recommendations of City Staff; and WHEREAS, the Planning Commission. found that the proposed location of the conditional use is in accord with the objectives of the zoning ordinance and the purposes of the district in which the site is located; and WHEREAS, the Planning Commission found that the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity; and WHEREAS, the Planning Commission also found that the proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance of the City of Pleasanton. NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES THE FOLLOWING: Section 1. Approves case UP-63-6, application of Earl and Barbara Adams for a conditional use permit to operate a 2350 sq. ft. restaurant at 3657 Old Santa Rita Road subject to the following conditions: 1. That the use permit is granted for an approximately 2350 sq, ft. restaurant to be located in the building at 3657 Old Santa Rita Road. 2. That the restaurant shall contain a maximum o£ 70 seats. 3. That parking meeting all code requirements for the ~- entire parcel located at 3.657-75 Old Santa Rita Road shall be provided prior to occupancy of the restaurant. 4. That prior to occupancy of the restaurant, a comprehensive sign program be approved by the Planning staff for the entire building at 3657 Old Santa Rita Road and that all signs be made to conform to said sign program.
