CITY COUNCIL OF THE CITY OF PLEASANTON COUNTY OF ALAMEDA, CALIFORNIA RESOLUTION NO. 89-73 RESOI/3TION APPROVING SUPPI.RMENTAL EASEMENT AGREEMENT WITH UNION PACIFIC RAILROAD COMPANY WHEREAS, the Union Pacific Railroad Company has tendered to the city of Pleasanton, California, a Supplemental Easement Agreement to add a 21-inch sanitary sewer pipeline encroachment within an existing 10-inch sanitary sewer easement on the Railroad Company's right of way, at M.P. 41.7, Pleasanton, California; and WHEREAS, the Council of the City of Pleasanton has said proposed agreement before it and has given it careful review and consideration; and WHEREAS, it is considered that the best interests of City will be subserved by the acceptance of said agreement; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PLEASANTON: Section 1: That the terms of the agreement submitted by Union Pacific Railroad Company as aforesaid be, and the same are hereby accepted in behalf of City. Section 2: That the Mayor is hereby authorized, empowered and directed to execute said agreement on behalf of the City and the City Clerk is hereby authorized and directed to attest said agreement and to attach to each duplicate original of said agreement a certified copy of this resolution. Section 3: This resolution shall become effective immediately upon its passage and adoption.
