PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2185 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON APPROVING A USE PERMIT TO <br />OPERATE A FOOD STORE AS FILED UNDER CASE UP-82-9 <br />WHEREAS, John Hurwitz, Robert Slower and Tam Investments, Inc. <br />have applied for a conditional use permit to operate <br />a food store approximately 1,000 sq. ft. in size <br />specializing in fish products at 3059 Hopyard Road; and <br />WHEREAS, the property is zoned C-C (Central Commercial) District; and <br />WHEREAS, a duly noticed public hearing was held on June 24, 1982 <br />at which time all public testimony and pertinent documents <br />were considered; and <br />WHEREAS, the Planning Commission found that the proposed location of <br />the conditional use is in accord with the objectives of the <br />Ordinance Code of the City of Pleasanton and the <br />purposes of the district in which the site is located; and <br />b+1HEREAS, the Planning Commission found that the proposed location <br />of the conditional use and the conditions under which it would <br />be operated or maintained will not be detrimental to the <br />public health, safety or welfare or be materially injurious <br />to properties or improvements in the vicinity; and <br />WHEREAS, that the proposed conditional use will comply with each of <br />the applicable provisions of this chapter. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES THE FOLLOWING: <br />Section 1. Approves case UP-82-9, the application for a conditional <br />use permit to operate a food store approximately 1,000 sq. <br />ft. in size specializing in fish products at 3059 Hopyard <br />Road (Hopyard Village) subject to the following conditions: <br />1. That case UP-82-9 is granted for a fish market to <br />occupy only Suite K of the building located at <br />3059 Hopyard Road; <br />2. That the entire parking area of the shopping center shall <br />be striped to meet City standards prior to occupancy of <br />the fish market. <br />
