PLANNING COMPdISSIOLd <br />CITY OF PLEASANTON <br />_ COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2186 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY <br />OF PLEASANTON UPHOLDING THE APPEAL OF PHILIP YOUNGER <br />REGARDING CASE PUD-80-8 AND A MODIFICATION TO THAT <br />APPROVED PLANNED UNIT DEVELOPMENT <br />WHEREAS, James Price, a developer of a 34 unit townhouse complex <br />under construction on the north side of Black Avenue <br />between Harvest Road and Crestline Road requested a <br />minor modification to case PUD-80-8, the original PUD <br />approving the project to allow replacing the required <br />masonry wall with a wooden-type fence; and <br />WHEREAS, this modification was approved by the Zoning Administrator <br />subject to an appeal period of 20 days; and <br />WHEREAS, Mr. Philip Younger, a neighbor to the north of the <br />subject development, appealed the decision of the zoning <br />administrator; and <br />WHEREAS, this matter then went before the Planning Commission at their <br />duly noticed public hearing of June 24, 1982; and <br />WHEREAS, the Planning Commission considered the plea of the <br />neighbors to the north of the project to not allow a <br />wooden-type fence in place of the masonry wall. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES AS FOLLOWS: <br />Section 1. Upholds the appeal of Philip Younger; thus, requires <br />that the masonry wall be installed to the north of the <br />planned unit development (PUD-80-8) as described in the <br />conditions of the ordinance approving that project. <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption. <br />PASSED AND ADOPTED by the Planning Commission of the City of Pleasanton <br />on the 24th day of June 1982 by the following vote: <br />AYES: Commissioners Doherty, Getty, Jamieson, Wilson and <br />Chairperson Lindsey <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />
