PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2000 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON DENYING A REZONING FOR <br />WILLIAM AVILLA AS FILED UNDER CASE RZ-81-6 <br />WHEREAS, William Avilla applied to rezone an approximately 1.62 <br />acre site from "A" (Agricultural) to "C-S" (Commercial <br />Service) District; and <br />WHEREAS, a public hearing was held on May 20, 1981 at which time <br />all pertinent documents and testimony were considered; and <br />WHEREAS, there is an unoccupied residence on the site and the <br />proposal includes rehabilitation of the residence to <br />be used as a furniture store; and <br />WHEREAS, the subject property is located on a segment of Stanley <br />Boulevard which has not yet been widened to its ultimate <br />width. Plans call for this section of the street to be <br />widened on its south side by as much as 38 feet. Such a <br />widening would bring the right-of-way line of the street <br />to within 6 ft, of the house; and <br />WHEREAS, access to and from the subject site may be difficult and <br />inconvenient if Stanley Boulevard remains unfinished in <br />this area; and <br />WHEREAS, sewerage is not presently available to the site and <br />either a holding tank or septic tank would have to be <br />approved prior to the residence being used as a furniture <br />store. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES THE FOLLOWING: <br />Section 1. The Planning Commission denies (without prejudice) case <br />RZ-81-6 because the owner stated he is not in a position <br />financially to comply with the recommended conditions of <br />approval concerning improvements related to his proposal. <br />Section 2. This resolution shall become effective immediately upon <br />its passage and adoption. <br />PASSES AND ADOPTED by the Planning Commission of the City of Pleasanton <br />on the 20th day of May 1981 by the following vote: <br />AYES: Commissioners Getty, Lindsey and Chairperson Wilson <br />NOES: None <br />ABSENT: Commissioners Doherty and Jamieson <br />ABSTAIN: None <br />
