PLANNING COMMISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 2000 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON DENYING A REZONING FOR WILLIAM AVILLA AS FILED UNDER CASE RZ-81-6 WHEREAS, William Avilla applied to rezone an approximately 1.62 acre site from "A" (Agricultural) to "C-S" (Commercial Service) District; and WHEREAS, a public hearing was held on May 20, 1981 at which time all pertinent documents and testimony were considered; and WHEREAS, there is an unoccupied residence on the site and the proposal includes rehabilitation of the residence to be used as a furniture store; and WHEREAS, the subject property is located on a segment of Stanley Boulevard which has not yet been widened to its ultimate width. Plans call for this section of the street to be widened on its south side by as much as 38 feet. Such a widening would bring the right-of-way line of the street to within 6 ft, of the house; and WHEREAS, access to and from the subject site may be difficult and inconvenient if Stanley Boulevard remains unfinished in this area; and WHEREAS, sewerage is not presently available to the site and either a holding tank or septic tank would have to be approved prior to the residence being used as a furniture store. NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES THE FOLLOWING: Section 1. The Planning Commission denies (without prejudice) case RZ-81-6 because the owner stated he is not in a position financially to comply with the recommended conditions of approval concerning improvements related to his proposal. Section 2. This resolution shall become effective immediately upon its passage and adoption. PASSES AND ADOPTED by the Planning Commission of the City of Pleasanton on the 20th day of May 1981 by the following vote: AYES: Commissioners Getty, Lindsey and Chairperson Wilson NOES: None ABSENT: Commissioners Doherty and Jamieson ABSTAIN: None
