f. The City shall be responsible for fire insurance <br /> costs for Amador Theater (not including the Girls Gymnasium <br /> attached thereto). <br /> <br /> g. City will ensure that appropriate energy <br /> conservation practices are followed within the Theater. City <br /> shall adopt and follow reasonable energy management policies <br /> as suggested by District. Both agencies shall cooperate to <br /> insure adequate sanctions for failure to follow energy <br /> management policies. <br /> <br /> h. City will pay the cost of utilities subject to <br /> reimbursement of one-half of the cost of those utilities from <br /> the District as provided in paragraph 6(a). City will bill <br /> District once annually for the prior fiscal year. <br /> <br /> 6. Operational Costs: District Responsibility. <br /> <br /> a. District shall reimburse the City for one-half of <br /> the annual cost for utilities, including gas, electricity, <br /> water, sewer and trash. <br /> <br /> b. The District shall provide liability insurance for <br /> injury to persons within the area controlled by the District <br /> - basically all areas outside the Theater including the <br /> adjacent parking areas. Said insurance shall be provided in <br /> accordance with standard policy limits and levels of <br /> self-insured retention which apply to other similar <br /> operations of the District. The District will hold harmless, <br /> indemnify and defend the City for injury to persons within <br /> the area controlled by the District based upon dangerous <br /> conditions of public property. <br /> <br /> c. District shall maintain exterior grounds adjacent <br /> to the Theater up to District standards. <br /> <br /> d. District agrees to repay City if District users <br /> damage the facility or if the custodial time required to <br /> clean the facility during or after District use is beyond <br /> normal due to lack of user cleanup. <br /> <br /> e. District will cooperate to make Amador High School <br /> parking available to persons attending events at the Theater <br /> and will exercise best efforts to obtain cooperation for <br /> overflow parking to locate at Alisal School. The provisions <br /> of this section will be applied in accordance with paragraphs <br /> 4(a) through (c) above. <br /> <br /> 7. Capital Improvements. City can make capital <br />improvements and add fixtures to the Theater subject to the <br />following: <br /> <br /> a. District understands that the City will not submit <br /> or qualify proposed capital improvements to the State <br /> Architects Office. School District will provide City with <br /> <br /> - 4 - <br /> <br /> <br />
