PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2069 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON RECOMMENDING APPROVAL FOR <br />PLANNED UNIT DEVELOPMENT ZONING AND DEVELOPMENT <br />PLAN APPROVAL FOR BREILH HOMES, INC. AS FILED <br />UNDER CASE PUD-81-20. <br />WHEREAS, Breilh Homes, Inc. has applied for Planned Unit Develop- <br />ment (PUD-High Density Residential) zoning and development <br />plan approval for a 32 unit townhouse condominium project <br />to be located on the 2± acre site on the south side of <br />Palomino Drive between Pico Avenue and Concord Street; and <br />WHEREAS, the property is zoned O (Office) District; and <br />WHEREAS, a public hearing was held on September 16, 1981 at which <br />time all public testimony and exhibits were reviewed and <br />considered. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES AS FOLLOWS: <br />Section 1. The Planning Commission finds that Planned Unit <br />_ Development zoning is in conformance with the General <br />Plan. <br />Section 2. The Planning Commission recommends approval of case <br />PUD-81-20 subject to the following conditions: <br />1. That the development be substantially as shown on <br />the development plan, Exhibit A, on file with the <br />Planning Division. <br />2. That the first two parking spaces adjacent to Palomino <br />Drive shall be moved to the south and the planting areas <br />to the north of them enlarged. <br />3. That the emergency access to Pico Avenue shall be <br />designed to the satisfaction of the Fire Chief. <br />4. That automatic garage door openers shall be provided <br />at least for garages number 1 through 6 and the <br />eastern portion of garage number 8. <br />5. That prior to issuance of a building permit, the <br />developer shall submit CC&RS for the development <br />for approval by the City Attorney. The CC&Rs <br />shall provide for a homeowners association with <br />sufficient power to manage all commonly owned <br />~-- areas. The City shall be named as beneficiary <br />of such CC&Rs and granted the power to enforce the <br />provisions if the homeowners association fails to <br />do so . <br />
