PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2076 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON RECOMMENDING APPROVAL OF A <br />NEGATIVE DECLARATION PREPARED FOR CASE RZ-81-20 <br />AS FILED BY HARRY HEMPY ET AL <br />WHEREAS, Harry and Evelyn R. Hempy and Robert and Margaret <br />Starnes have applied to rezone an approximately 9 <br />acre site located on the vJgSt side of Foothill <br />Road north of Highland Oaks Drive in the <br />vicinity of 5050 and 5100 Foothill Road from the "A" <br />(Agriculture) to the R-1-40,000 (Single-family Residential) <br />District or to any other zoning district consistent with <br />the General Plan; and <br />WHEREAS, at its meeting of October 14, 1981, the Planning Commission <br />received a proposed negative declaration for case RZ-81-20; and <br />WHEREAS, the Planning Commission has received and reviewed the Initial <br />Study dated October 14, 1981 and received the recommendations <br />of the staff; and <br />WHEREAS, a duly noticed public hearing was held at which time the <br />public was given the opportunity to comment on the <br />environmental impacts of the proposed development plans; and <br />WHEREAS, the Planning Commission has reviewed the potential impacts <br />in accordance with the applicable state and local guidelines <br />governing the preparation of mitigated negative declarations <br />and environmental impact reports; and <br />WHEREAS, the Planning Commission finds the proposed application <br />(RZ-81-20) would not have any significant adverse effects <br />on the environment. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approves the negative declaration for the rezoning of <br />an approximately 9 acre site located on the west side of <br />Foothill Road north of Highland Oaks Drive in the vicinity <br />of 5050 and 5100 Foothill Road as filed under case RZ-81-20. <br />Section 2. This resolution shall become effective immediately upon <br />its passage and adoption. <br />PASSED AND ADOPTED by the Planning Commission of the City of <br />Pleasanton on the 14th day of October 1981 by the following <br />vote: <br />AYES: Commissioners Doherty, Jamieson, Lindsey, Wilson and <br />Chairperson Getty <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />
