PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAP4EDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2077 <br />A RESOLUTION OF THE PLANNING COMMISSION <br />RECOMMENDING APPROVAL OF A ZONING CHANGE <br />FOR HARRY HEMPY ET AL AS FILED UNDER <br />CASE RZ-81-20 <br />WHEREAS, Harry and Evelyn R. Hempy and Robert and Margaret <br />Starnes have applied to rezone an approximately 9 <br />acre site located on the west side of Foothill <br />Road north of Highland Oaks Drive in the vicinity of 5050 <br />and 5100 Focthill Road from the "A" (Agriculture) <br />to the R-1-40,000 (Single-family Residential) <br />District or to any other zoning district consistent <br />with the General Plan; and <br />WHEREAS, a duly noticed public hearing was held on October 14, <br />1981 at which time all public testimony and documents <br />were received and considered. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES THE FOLLOWING: <br />,.-. Section 1. The Planning Commission recommends the property <br />described in case RZ-81-20 be rezoned to the <br />PUD-Low Density Residential District and that this <br />zoning is consistent with the General Plan subject <br />to the following conditions: <br />1. That this rezoning is only for the 5.48 acre site <br />known as 5000 Foothill Road and the 3.48 <br />acre site known as 5050 Foothill Road. <br />2. That the applicant be aware that either in <br />conjunction with development plan approval of the <br />subject properties or subdivision of the subject <br />properties, the staff will request full utilities <br />(including sewer) be provided to both parcels, and <br />that depending upon the number of new parcels proposed, <br />that a minimum 24 ft. wide paved public road be provided <br />in place of the 20 ft. wide unpaved access easement. <br />Section 2. This resolution shall become effective immediately <br />upon its passage and adoption. <br />PASSED AND ADOPTED by the Planning Commission of the <br />City of Pleasanton on the 14th day of October 1981 b_y <br />the following vote: <br />AYES: Commissioners Doherty, Jamieson, Lindsey, Wilson and <br />Chairperson Getty <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />
