PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2518 <br />A RESOLUTION OF THE PLANNING COMMISSION <br />OF THE CITY OF PLEASANTON RECOMMENDING <br />APPROVAL OF A MODIFICATION FOR DEER OAKS <br />AS FILED UNDER CASE PUD-82-13-2M <br />WHEREAS, the developers of the Deer Oaks Development have requested <br />that a modification be made to two conditions of approval <br />of the Deer Oaks PUD, a 24 unit single family residential <br />project on the approximately 48 acre site located on <br />the west side of Foothill Road, northwest of its intersection <br />with Bernal Avenue; and <br />WHEREAS, zoning for the property is PUD-Low Density Residential <br />and Open Space District; and <br />WHEREAS, Condition No. 14 of PUD-82-13 governing the Deer Oaks <br />Development requires that the large oak tree near the <br />former stable on the site be repaired and maintained <br />in a healthy condition at all times; and <br />'- WHEREAS, as a result of soil removal, compaction, deep trenching <br />and paving adjacent to the tree, in the opinion of <br />two tree experts, have probably made it impossible <br />to save the tree even with proper watering and professional <br />trimming and cableing; and <br />WHEREAS, Condition No. 68 of the PUD requires that the emergency <br />access road between the Deer Oaks Drive and the end <br />of Twelve Oaks Drive be surfaced to the satisfaction <br />of the Fire Marshal and Director of Public Works in <br />order to provide an emergency exit (downhill only) <br />and adequate access for maintenance of the water line <br />in that area; and <br />WHEREAS, the developers are requesting a modification to case <br />PUD-82-13 to allow the removal of the oak tree and <br />construction of the emergency access road without a <br />paved surface; and <br />WHEREAS, since tree removal has been controversial on the Deer <br />Oaks site, the request for modification is being submitted <br />to the Planning Commission and City Council for action; <br />and <br />
