PLANNING COMMISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION N0. 2518 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON DENYING A CONDITIONAL USE PERMIT FOR KENTUCKY FRIED CHICKEN AS FILED UNDER CASE UP-84-31 WHEREAS, Kentucky Fried Chicken and Tancor Lease have applied for conditional use permit approval to allow for a drive-through sales window and related facilities at an existing restaurant located at 1803 Santa Rita Road; and WHEREAS, zoning for the property is PUD (Planned Unit Development)-Central Commercial District; and WHEREAS. this matter was first considered Planning Commission suggested at applicant consider relocating th through window to the north side because of concerns with traffic Road; and in th =_ir of on June 1984 and the st time that the proposed drive the restaurant and off Santa Rita WHEREAS, the applicant revised the plan to show the removal of three parking spaces and the existing trellis on the north side of the building to accommodate the drive-through facility; and WHEREAS, at their duly noticed public hearing of September 12, 1984 the Planning Commission considered the revised plans and proposal of the applicant and could not make the findings required to grant approval of this conditional use permit. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Denies case UP-84-31, application of Kentucky Fried Chicken for a conditional use permit to allow the addition of a drive-through facility to the Kentucky Fried Chicken restaurant located at 1803 Santa Rita Road because findings required to grant this use permit cannot be made. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed.
