PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2526 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON REQUIRING THAT BARRATT HOMES REMOVE <br />THE FLAG POLE AT THEIR MODEL <br />HOME COMPLEX ON VIA DE LOS MZLAGROS <br />WHEREAS, Barratt Homes has a model home and sales complex located <br />in Via de Los Milagros (immediately west of its <br />intersection with Valley Avenue); and <br />WHEREAS, Barratt Homes has caused a 35 ft. flag pole flying the <br />American Flag to be installed at this complex without <br />benefit of City approval; and <br />WHEREAS, Condition No. 6 of the approval of the use permit <br />governing their model home and sales complex states <br />"that no flags, banners, pinwheels, pennants or similar <br />attention attracting devices shall be utilized in the <br />complex;" and <br />WHEREAS, the Director of Planning and Community Development made <br />the interpretation that a 35 ft. flag pole in the model <br />home complex is an "...attention attracting device... <br />and violates Condition No.6 of Barratt's conditional use <br />permit for a model home and sales complex and informed <br />Barratt Homes that it should be removed; and <br />WHEREAS, at their duly noticed public hearing of September <br />26,1984 Doug Kirsey of Arnold Pierce and Company made an <br />appeal to the Planning Commission to interpret Condition <br />No. 6 differently than did the Director of Planning and <br />Community Development. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Concurs with the interpretation of the Director of <br />Planning and Community Development regarding the 35 ft. <br />flag pole and determines that it violates condition No. <br />6 of Barratts conditional use permit. <br />Section 2. This resolution shall become effective immediately <br />upon its passage and adoption. <br />
