PLANNING COMMISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION N0. 2526 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON REQUIRING THAT BARRATT HOMES REMOVE THE FLAG POLE AT THEIR MODEL HOME COMPLEX ON VIA DE LOS MZLAGROS WHEREAS, Barratt Homes has a model home and sales complex located in Via de Los Milagros (immediately west of its intersection with Valley Avenue); and WHEREAS, Barratt Homes has caused a 35 ft. flag pole flying the American Flag to be installed at this complex without benefit of City approval; and WHEREAS, Condition No. 6 of the approval of the use permit governing their model home and sales complex states "that no flags, banners, pinwheels, pennants or similar attention attracting devices shall be utilized in the complex;" and WHEREAS, the Director of Planning and Community Development made the interpretation that a 35 ft. flag pole in the model home complex is an "...attention attracting device... and violates Condition No.6 of Barratt's conditional use permit for a model home and sales complex and informed Barratt Homes that it should be removed; and WHEREAS, at their duly noticed public hearing of September 26,1984 Doug Kirsey of Arnold Pierce and Company made an appeal to the Planning Commission to interpret Condition No. 6 differently than did the Director of Planning and Community Development. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Concurs with the interpretation of the Director of Planning and Community Development regarding the 35 ft. flag pole and determines that it violates condition No. 6 of Barratts conditional use permit. Section 2. This resolution shall become effective immediately upon its passage and adoption.
