CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-38 <br /> <br /> RESOLUTION CLARIFYING CERTAIN CONDITIONS <br /> OF APPROVAL FOR TRACT 5835, VINTAGE <br /> HEIGHTS II <br /> <br />WHEREAS, in January 1988, the City Council conditionally <br /> approved a tentative map for the Vintage Heights II <br /> subdivision (Tract 5835); and <br /> <br />WHEREAS, one of the conditions of the tentative map was that <br /> with respect to Lots 1-4 and 6-13, the houses to be <br /> constructed thereon were limited to a single story <br /> in height; and <br /> <br />WHEREAS, in January 1989, after construction of one of the <br /> houses (on Lot 11) had started, residents in the <br /> area expressed concern that the conditions of <br /> approval including the single story height <br /> limitation, were not being complied with; and <br /> <br />WHEREAS, at its meeting of January 17, 1989, City Council <br /> considered public testimony concerning the <br /> representations which the developers had made to <br /> the adjacent property owners, and reviewed and <br /> considered the records, files, and Council minutes <br /> concerning this project. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The first sentence of Condition 21 of the <br /> Conditions of Approval for Tract 5835, Vintage <br /> Heights II, which reads: "That the houses to be <br /> constructed on Lots 1-4 and 6-13 be limited to a <br /> single story in height" shall mean that the peak <br /> roof height of each house shall not exceed eighteen <br /> (18) feet. <br /> <br />Section 2: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
