PUD-84-18 <br />Exhibit "A" <br />Planning Commission Resolution No. 2577 <br />1. That the development be substantially as shown on the <br />development plan, Exhibit A, on file with the Planning <br />Department. <br />2. That the developers shall retain the 48.3 ft., 36 in. <br />diameter walnut tree immediately northwest of the northwest <br />corner of the Bottini property. <br />3. That the developer shall employ all measures necessary to <br />preserve the health of all existing trees shown on the <br />development plan to be retained during construction of the <br />proposed project. Such measures shall include but not <br />necessarily be limited to providing barricades around the <br />trees to protect their trunks, roots and low hanging <br />branches. These barricades shall be set far enough from the <br />trees to protect them from soil compaction and excavation. <br />4. That prior to issuance of a building permit, the developer <br />shall prepare an acoustical analysis of all units in the <br />project to determine the construction methods necessary to <br />maintain an interior noise level of no greater than 45 dBA <br />Ldn. The analysis shall be based upon future projected <br />train traffic on the bordering railroad tracks. These <br />construction techniques shall be included as part of the <br />building plan submittal. <br />5. That an 8 ft. high masonry (or other material acceptable to <br />the Planning Director) wall shall be constructed along the <br />entire length of the northern property line of the subject <br />property to shield users of the tot lot from railroad noise. <br />A similar wall shall be constructed along the western <br />property line from the picnic area to the northern property <br />line and along the entire length of the eastern property <br />line which borders the Madden property. In these two areas <br />the height of the wall may be reduced to 6 ft. if noise <br />attenuation is sufficient. <br />6. That the developer dedicate to the City for street <br />right-of-way purposes a 9 ft. wide parcel of land across the <br />Stanley Boulevard frontage of the development. <br />7. That if, in the opinion of the City Engineer, it proves to <br />be impractical to construct the Stanley Boulevard street <br />frontage improvements without constructing the improvements <br />on one or both adjacent lots, Standard Condition number 29 <br />(deferred improvement agreement) may be required instead of <br />condition number 28. <br />8. The precise location of the driveway approach onto Stanley <br />Boulevard shall be subject to final design. <br />- 9. That the developer file and process a tentative tract map <br />for this development. The PUD site development plan will be <br />subject to possible change, at that time, with respect to <br />utility systems and topography. <br />- 1 - <br />
