AMENDMENT N0. 2 <br /> TO <br /> CONTRACT FOR CONSULTANT SERVICES <br /> <br /> THIS AMENDMENT NO. 2 hereby amends the Agreement for <br />Consultant Services made and entered into on February 12, 1985', by <br />and between the CITY OF PLEASANTON, a municipal corporation, <br />(hereinafter "City") and BISSELL & KARN, INC., a California <br />corporation (hereinafter "Consultant"). <br /> <br /> WITNESSETH: <br /> <br /> A. Bissell & Karn, Inc. entered into an agreement with the <br />City to complete the design for Stage 2 of the Hopyard Road/I-580 <br />interchange improvements. <br /> <br /> B. Stage 2 design work consisted of new overcrossing and <br />adjacent approach roadways and was estimated to cost <br />$3,000,000.00. <br /> <br /> C. Exhibit B of said contract states that charges for <br />reproduction are not included in the maximum fee amount included <br />in paragraph 7 of the contract. <br /> <br /> D. The City has directed consultant to provide reproduced <br />prints and plans for review and construction. <br /> <br /> E. Compensation for reproduction charges in the amount of <br />$28,736.00 were requested by Consultant. Compensation for <br />additional design costs have also been submitted and are the <br />subject of further discussion. <br /> <br /> NOW, THEREFORE, City and Consultant agree to amend Paragraph <br />7 of the original agreement dated February 12, 1985 as follows: <br /> <br /> "7. For the services to be rendered hereunder, the City <br />shall pay Consultant on a time-and-materials basis, but the amount <br />paid for Consultant's services shall not exceed the sum of Five <br />Hundred Fifteen Thousand Four Hundred Forty Six and 00/100 Dollars <br />($515,446.00), based on Consultants current annual compensation <br />and rate schedule attached hereto as Exhibit "B", and incorporated <br />herein by this reference. Partial payment shall be submitted on a <br />monthly basis in proportion to the percentage of work completed, <br />upon receipt of Consultant's invoice and the approval of the <br />Public Works Director as to the percentage completion claimed. <br />Payment shall be made within thirty (30) days of receipt of <br />Consultant's invoice." <br /> <br /> <br />
