recover cost of an incomplete item not listed so long as the <br />amount does not exceed $58,150. The cashier's check will be <br />refunded within thirty (30) days of completion of items on <br />Attachment "B", and as amended by City prior to February 17, <br />1989, subject to any deduction for work not completed by <br />Contractor. <br /> <br /> 3. Liquidated Damaqes. City agrees to waive all <br />claims for liquidated damages due under this contract and its <br />amendments. <br /> <br /> 4. Warranty Period. The last day of the project <br />warranty period shall be January 17, 1990, except as stated <br />in two letters dated November 9, 1988 and November 10, 1988 <br />between S. J. Amoroso and City, attached hereto as Attachment <br />"C" and incorporated herein by this reference.
