PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2690 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON APPROVING A CONDITIONAL USE PERMIT FOR LUKE <br />BOSWELL FILED UNDER CASE UP-85-32 <br />WHEREAS, Luke Boswell, Inc. has applied for a conditional use <br />permit for a wholesale establishment for the <br />distribution of paper goods and related products to be <br />located at 39 California AVenue; and <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development)-Commercial Service District; and <br />WHEREAS, at their duly noticed public hearing of August 14, 1985 <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission found that a) the proposed <br />location of the conditional use is in accordance with <br />the objectives of the Zoning Ordinance and the purposes <br />of the district in which the site is located; the <br />proposed use is a business that is more suited for the <br />PUD Commercial Service(CS) Zoning District as opposed to <br />a commercial shopping center. The proposed use is <br />compatible with other similar uses (mixed office, <br />warehouse and retail) within the complex; b) that the <br />proposed location of the conditional use and the <br />conditions under which it would be operated or <br />maintained will not be detrimental to the public health, <br />safety, or welfare, or be materially injurious to the <br />properties or improvements in the vicinity; the building <br />was designed with ample parking and fire protection in <br />order to accommodate this type of use; and c) that the <br />proposed conditional use will comply with each of the <br />applicable provisions of the Zoning Ordinance; and as <br />proposed and conditioned, each applicable provision has <br />been satisfied; and <br />WHEREAS, this project is categorically exempt from CEQA; <br />therefore, no environmental document accompanies this <br />application. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves Case UP-85-32, application of Luke Boswell <br />as herein described subject to the following conditions: <br />
