PLANNING COMMISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 2696 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON APPROVING A CONDITIONAL USE PERMIT FOR CHARLES LEEB AS FILED UNDER CASE UP-85-33 WHEREAS, Charles Leeb has applied for a conditional use permit to allow warehousing of photography supplies and equipment to be located at 39 California Avenue; and WHEREAS, zoning for the property is PUD (Planned Unit Development)-Commercial Service District; and WHEREAS, at their duly noticed public hearing of August 28, 1985 the Planning Commission considered all public testimony, relevant exhibits and recommendations of the City staff concerning this application; and WHEREAS, the Planning Commission found a) that the proposed location of the conditional use is in accord with the objectives of the ordinance code and the purposes of the district in which the site is located: the proposed use, as conditioned, is a business appropriate for the PUD Commercial Service (CS) Zoning District as opposed to a commercial shopping center. The proposed use is compatible and similar to other uses within the complex; b) that the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare, or be materially injurious to properties or improvements in the vicinity: The building was designed with appropriate parking and loading facilities to accommodate this type of use and the uses will be subject to relevant requirements of the Building Department and Fire Department and c) that the proposed conditional use will comply with each of the applicable provisions of the ordinance code; and as proposed and conditioned, each applicable provision will be satisfied. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves case UP-85-33, application of Charles Leeb for a conditional use permit to allow warehousing of photography supplies and equipment to be located at 39 California Avenue subject to the following conditions:
