PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2696 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON APPROVING A CONDITIONAL USE PERMIT FOR <br />CHARLES LEEB AS FILED UNDER CASE UP-85-33 <br />WHEREAS, Charles Leeb has applied for a conditional use permit to <br />allow warehousing of photography supplies and equipment <br />to be located at 39 California Avenue; and <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development)-Commercial Service District; and <br />WHEREAS, at their duly noticed public hearing of August 28, 1985 <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission found a) that the proposed <br />location of the conditional use is in accord with the <br />objectives of the ordinance code and the purposes of the <br />district in which the site is located: the proposed use, <br />as conditioned, is a business appropriate for the PUD <br />Commercial Service (CS) Zoning District as opposed to a <br />commercial shopping center. The proposed use is <br />compatible and similar to other uses within the complex; <br />b) that the proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public health, <br />safety or welfare, or be materially injurious to <br />properties or improvements in the vicinity: The building <br />was designed with appropriate parking and loading <br />facilities to accommodate this type of use and the uses <br />will be subject to relevant requirements of the Building <br />Department and Fire Department and c) that the proposed <br />conditional use will comply with each of the applicable <br />provisions of the ordinance code; and as proposed and <br />conditioned, each applicable provision will be <br />satisfied. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves case UP-85-33, application of Charles Leeb <br />for a conditional use permit to allow warehousing of <br />photography supplies and equipment to be located at 39 <br />California Avenue subject to the following conditions: <br />
