PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2741 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY <br />OF PLEASANTON DENYING A USE PERMIT FOR KRIS AAKER AS <br />FILED UNDER CASE UP-85-51 <br />WHEREAS, Kris Aaker has applied for a conditional use permit to <br />allow for the raising of homing pigeons at 5636 San Juan <br />Way; and <br />WHEREAS, zoning for the property is R-1-6500 (Single-family <br />Residential) District; and <br />WHEREAS, at their duly noticed public hearing of January 8, 1986 <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the staff <br />concerning this application; and <br />WHEREAS, three separate findings must be made to grant approval <br />of a conditional use permit; and <br />WHEREAS, the Planning Commission could not make the finding that <br />the proposed location of the conditional use and the <br />conditions under which it would be operated or <br />maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the <br />properties or improvements in the vicinity. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Denies Case UP-85-51, application of Kris Aaker for a <br />conditional use permit to allow for the raising of <br />homing pigeons at 5636 San Juan Way. <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption. <br />PASSED AND ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON ON THE 8TH DAY OF JANUARY 1986 BY THE FOLLOWING VOTE: <br />AYES: Commissioners Innes, Lindsey, Michelotti, Wellman <br />and Chairman Wilson <br />NOES: None <br />ABSENT: Commissioner Hoyt <br />ABSTAIN: None <br />DATE: January 8, 1986 <br />
