CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-318 <br /> <br /> RESOLUTION APPROVING THE APPEAL OF A <br /> DECISION OF THE BOARD OF ADJUSTMENT AND <br /> DENYING THE APPLICATION OF ANDREW VALDEZ <br /> FOR A VARIANCE AS FILED UNDER CASE <br /> V-89-9 <br /> <br />WHEREAS, at its meeting of June 14, 1989, the Board of <br /> Adjustment approved the application of Andrew <br /> Valdez for a variance from the Municipal Code to <br /> allow the retention of an existing deck structure, <br /> spa, and shed which encroaches into the required <br /> rear yard setback at 906 Crellin Road; and <br /> <br />WHEREAS, zoning for the property is R-1-6500 (Single-family <br /> Residential) District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton <br /> Municipal Code, the City Council submitted an <br /> appeal to the City Clerk of the City of Pleasanton; <br /> and <br /> <br />WHEREAS, a duly noticed public hearing was held before the <br /> City Council on July 18, 1989 at which time the <br /> applicant and other members of the public were <br /> offered an opportunity to present evidence <br /> regarding this appeal; and <br /> <br />WHEREAS, the City Council was unable to make the following <br /> findings; <br /> <br /> 1. That special circumstances unique to the site <br /> are to be found. <br /> <br /> 2. That the proposal will not constitute a grant <br /> of special privilege. <br /> <br /> 3. That the health, safety and general welfare of <br /> the surrounding area re not jeopardized by the <br /> request. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br /> <br />
